Terms of Service

This is an English translation of the Japanese Terms of Service. If there is any difference between the two, the Japanese version prevails.

Your use of Gravemark (the "Service") is governed by the following terms (the "Terms") set by Tokyo hammock Inc. (the "Company"). Please read every provision of the Terms before you use the Service. If you are a minor, you cannot agree to the Terms yourself. A parent or other legal guardian must agree to the Terms on your behalf.

Purchase and use of paid content

In the Service you may purchase and use paid content made for the Service (such as characters, larger bags and stash space, and convenience features), in the currency that corresponds to your correct country of residence. The Company may also grant content, including paid content, free of charge in campaigns and on other occasions. Paid content and in-game currency (gold) cannot be exchanged for cash, goods or any other economic benefit.

Prices and other conditions of paid content are shown in the Service or on the official website of the Service. The Company may change these conditions at its discretion.

Paid content is licensed for use only to the customer who purchased it.

Except where required by law, the Company does not accept cancellations or give refunds at the customer's request once a purchase of paid content has been completed.

Purchases of paid content are made on the premise that you have agreed to the terms and other conditions of the third-party payment service provider, and you must comply with those conditions.

Prohibited conduct

You must not do any of the following.

Suspension of use

If the Company determines that any of the following applies or is likely to apply to you, it may suspend your use of the Service or take other measures without any notice.

Disclaimer

The Company accepts no liability for any disadvantage or damage you suffer as a result of using the Service.

The Company accepts no liability for any loss, malfunction or alteration of data in the Service.

If a dispute arises in connection with the Service between customers, or between you and a third party, you must notify the Company and resolve it at your own responsibility and expense. The Company has no obligation to become involved in the dispute and accepts no liability for it.

The Company accepts no liability for any disadvantage or damage arising from interruption, delay or suspension of the Service or deletion of data caused by failures of communication lines, computer systems or the like, or from unauthorized access to data.

Rights

All copyrights and other intellectual property rights in the Service belong to the Company or to third parties who have licensed their use to the Company.

The Company may use, free of charge and as part of the Service, any information you register or post within the Service.

Governing law and jurisdiction

The Terms are governed by and construed in accordance with the laws of Japan.

The Tokyo District Court or the Tokyo Summary Court has exclusive jurisdiction as the court of first instance over any dispute between the Company and you arising out of or in connection with the Terms.

Customer information provided to the Company

The Company sets out below how it handles the information you provide to it when you use the Service. To use the Service, you must agree to what is set out in this section. This section is an agreement between you and the Company, so please read all of it carefully. If you are a minor, you cannot agree to this section yourself. A parent or other legal guardian must agree to it on your behalf.

When you use the Service, the Company may obtain the following information (the "Collected Data").

(1) Information about your device (such as the device used, its OS, its language setting, the country you access from, and other identifiers unique to the device)

(2) Your use of the Service (such as the version of the Service and your usage history)

(3) Information about campaigns you have used

(4) Information you choose to send in the course of registering as a user of the Service or otherwise (including but not limited to country of residence, language, gender, user name and date of birth)

(5) Your location information

(6) Information about your purchases

Where the Collected Data is personal information as defined in Japan's Act on the Protection of Personal Information, or where the Company judges it to be equivalent to personal information, the Company handles it appropriately and takes the reasonable measures necessary to protect it from loss, theft, misuse, unauthorized access, leakage, alteration and damage.

The Company may use the Collected Data for the following purposes.

(1) Providing the Service to you

(2) Verifying your identity (including, for minors, that of a parent or guardian)

(3) Sending notices, conducting surveys and responding to inquiries

(4) Analyzing customer trends and providing services, advertising and other information suited to them

(5) Creating statistics on use of the Service, publishing those statistics in the Service or on the Company's website, and providing them to third parties

(6) Improving the quality of the Service and fixing defects

(7) Determining eligibility to enter campaigns

(8) Investigating suspected violations of the Terms

The Company does not disclose the Collected Data to third parties without your consent, except as set out in the next paragraph. Parties to whom the Company entrusts work that includes handling the Collected Data, to the extent necessary to achieve the purposes above, are not third parties for this purpose.

Despite the preceding paragraph and the fourth paragraph of this section, the Company may disclose the Collected Data without your consent in the following cases.

(1) Where required by law

(2) Where it is necessary to protect a person's life, body or property and it is difficult to obtain the consent of the person concerned

(3) Where it is especially necessary to improve public health or promote the sound growth of children and it is difficult to obtain the consent of the person concerned

(4) Where it is necessary to cooperate with a national or local government body, or a party entrusted by one, in carrying out duties prescribed by law, and obtaining the consent of the person concerned is likely to hinder those duties

When the Company deletes your account or ends the Service, it may delete all of the Collected Data at its discretion, and you agree to this in advance.

You agree in advance that, to improve the quality of the Service and fix defects, the Company may have a partner collect and analyze the following information using tools the partner operates. This collection and analysis does not allow the partner to identify you personally.

(1) Your account

(2) Configuration information such as the application and OS versions, device name and screen size

(3) Information on how the application is being used, such as network and memory status

(4) Information on crashes, such as when and where an error occurred

Changes to the Terms

The Company may change the Terms at any time. The changed Terms will be posted in the Service and take effect when they are posted.

Inquiries

As a rule, the Company responds to inquiries about the Service by email through the inquiry form. Please note that the Company may be unable to reply to every inquiry individually.
